Terms of Service

Last updated: October 13, 2026

These terms are an agreement between you and Spicey ("Spicey", "we", "us") about your use of https://spicey.app and the Spicey dashboard. By creating an account or placing an order you agree to them.

1. What Spicey is

Spicey is subscription software that lets restaurants take online pickup orders, manage reservations, publish a storefront, and run their kitchen. Restaurants (“owners”) subscribe to a plan. Their customers use the storefront to browse menus, order for pickup and reserve tables.

Spicey is the software provider. Each restaurant is the seller of its own food and is responsible for its menu, prices, taxes, preparation, food safety and pickup. We are not the restaurant and do not prepare or sell food.

2. Accounts

  • You must be at least 18 and able to enter a contract to open an owner account.
  • Give accurate information and keep your sign-in details safe. You are responsible for activity on your account, including your staff’s.
  • Tell us right away at support@spicey.app if you think your account has been misused.

3. Plans, fees and billing

  • Paid plans are billed in advance, monthly or yearly, through Stripe, in the currency shown at checkout. Prices are shown on the pricing section of our home page.
  • Plans renew automatically until cancelled. You can cancel at any time from the Billing page in your dashboard; see our Refund & Cancellation Policy.
  • Each plan sets how many restaurants and which features you can use. If you go over a limit you will be asked to upgrade.
  • We may change prices with at least 30 days’ notice before your next renewal. If you do not agree, cancel before the renewal.
  • Prices exclude applicable taxes, which we add where required.

4. Payments for orders

  • Customer card payments are processed by Stripe. Money for orders goes to the restaurant’s own Stripe account; the restaurant is responsible for completing Stripe’s identity checks and following Stripe’s terms.
  • When a customer orders, their card is only authorized. The payment is captured when the restaurant accepts the order, and released if the order is declined or cancelled.
  • Each restaurant sets its own sales tax rate. The restaurant is responsible for charging, collecting and remitting the correct tax.
  • We do not store card numbers. Card details go directly to Stripe.

5. What you may not do

  • Break the law, or sell anything illegal or unsafe through Spicey.
  • Place fake, fraudulent or test orders with real cards, or use stolen cards.
  • Upload content you do not have the right to use, or content that is hateful, misleading or harmful.
  • Try to break, overload, scrape or reverse-engineer the service, or access another restaurant’s data.
  • Resell the service without our written permission.

6. Your content

Menus, photos, blog posts and other content you add stay yours. You give us a licence to store, display and deliver it as needed to run the service, including on your storefront and embedded widgets. You promise you have the rights to everything you upload.

7. Privacy

How we handle personal information is explained in our Privacy Policy. Restaurants are responsible for how they use their customers’ details, such as sending them marketing.

8. Availability and changes

We work to keep Spicey running, but we do not promise it will always be available or error-free. We may update, add or remove features. Planned downtime is announced where we can.

9. Ending the agreement

You can stop using Spicey and cancel your plan at any time. We may suspend or close an account that breaks these terms, puts others at risk, or does not pay. After an account closes, we keep or delete data as described in the Privacy Policy. Restaurants should export what they need beforehand.

10. Liability

The service is provided “as is”. To the fullest extent the law allows, Spicey is not liable for indirect or consequential losses, lost profit or lost orders, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing here limits liability that cannot be limited by law. We are not responsible for what a restaurant sells, for delays or errors by Stripe, or for events outside our control.

11. Changes to these terms

We may update these terms. If a change matters, we will tell you by email or in the dashboard before it applies. Continuing to use Spicey after the change means you accept it.

12. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. Courts there have jurisdiction, except where your local consumer laws say otherwise.
